1. GENERAL ISSUES
    1.1: These Terms and Conditions apply to the City Ninja indoor assault course activity (the ‘Activity”).
    1.2: These Terms and Conditions contain important information concerning participation by You (‘the Participant’) and members of your party and, accordingly, You acknowledge and agree that you shall ensure that all members of your party are aware of and accept these Terms and Conditions.
    1.3: City Ninja is organised by Extreme Adventure Ltd. (the Organiser/the Company/We/Us) a company registered in England and Wales. Our company registration number is 5910765 and our registered office is at Foxdale Cottage, Bunbury Lane, Bunbury, Nr. Tarporley, Cheshire CW6 9QZ. Our registered VAT number is 995533766.
    1.4: No variation to these Terms and Conditions shall be binding unless agreed in writing by Extreme Adventure Ltd.
    1.5: The Organiser reserves the right to make changes to the Activity whether to conform with any applicable safety or other statutory requirements, requirements specified by a venue or otherwise.
    1.6: These Terms and Conditions incorporate Extreme Adventure’s Privacy Policy, which is available on our website, and Disclaimer.
  1. BOOKING CONFIRMATION
    2.1: No booking shall be deemed to have been accepted until written confirmation has been issued by the Organiser (which shall include email confirmation of booking issued by the online booking platform).
    2.2: You must advise the Organiser as soon as possible of any mistake in the booking confirmation.
    2.3: Extreme Adventure shall use its reasonable endeavours to ensure that Your  participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time to register and complete the safety briefing. Late arrivals may not be permitted to undertake the Activity and no refunds or compensation will be payable in such circumstances.
    2.4: All participants aged 16 and under must be accompanied by an adult for the duration of the Activity, although it is not a requirement that an adult accompanies any U16s on the obstacles.
  2. SAFETY
    3.1: The Activity is comprised of challenging obstacles and participation is not without risk. The Participant acknowledges and accepts that their participation in the City Ninja activity could result in physical or emotional injury to themselves or to third parties.  Please read our Safety Advice prior to participation.
    It is not a requirement that under 16s are accompanied onto the course by an adult, but a responsible adult should be present with any Participants under 16 at the venue throughout the Activity and provide their emergency contact details at registration.
    3.2: The Participant acknowledges and accepts that the Activities are physically demanding and carry inherent risks. The Participant acknowledges and accepts that the Activities are physically demanding and require a degree of agility, strength and stamina. Participants are advised to keep within their ability – only the individual knows or understands their own limits and competencies. If participants have medical concerns they are advised to consult their doctor in advance of registering for / taking part in the Activity. No refunds will be given if, after registering for the event, medical advice prevents You from taking part in the Activity.
    3.3: Due to the physical nature of the Activity the Organiser recommends that pregnant women should not take part and by accepting these terms participants confirm that they are not pregnant.  We also recommend that you seek medical advice before signing up if you suffer from, or have suffered in the past from, any pre-existing back, neck or musculoskeletal conditions.
    3.4: By signing these T&Cs you confirm that you do not suffer from any medical condition which would make it more likely that you would be involved in any incident which could result in injury to themselves or others.
    3.5: All participants are required to act responsibly and courteously at all times and to respect other participants.  We reserve the right to refuse admittance to the Activity or to remove a participant from the Activity should we deem it necessary to do so. This includes, but is not limited to, a participant who does not comply with the safety rules and advice of our Event Team, or who is deemed to be under the influence of alcohol or drugs.
    3.6: All participants must wear trainers / sports footwear when in the Activity area. Bare feet, socked feet, flip-flops, high heels, or any other footwear deemed unsuitable by the Event Team are not permitted.
    3.7: Participants will not be directly supervised by an instructor.
    3.8: The participant agrees that they, and those for whom they are booking places, will comply with the dress (see Clause 4), height and weight restrictions specified. Anyone who does not meet these requirements will not be allowed to undertake the Activities. It is your responsibility to ensure that all members of your party meet these requirements.
    3.8.1: All participants must be over 1.3m tall to take part in the Activity. Height may be measured at the event, and you accept that the decision of our Event Team is final.
    3.8.2: All participants must be reasonably fit and healthy and must weigh less than 20 stone/127kg.
    3.8.3: Participants need to be able to see similar distances to those required to drive a car in order to be able to complete the activity and to supervise any under 16’s in their care. Consequently, short or long-sighted participants must ensure that they wear contact lenses or prescribed glasses.
  1. CLOTHING
    4.1: It shall be the responsibility of all participants to ensure that they are dressed appropriately.  We advise participants to wear clothing appropriate for the activity, and which they do not mind getting damaged. In particular the following restrictions shall apply:
    i. Long hair must be tied back
    ii. No belts, jewellery or other sharp items of clothing that may cause damage to yourself, the equipment or other participants.
    iii. Trainers should be worn. Bare feet, socked feet, flip-flops, high heels, or any other footwear deemed unsuitable by the Event Team are not permitted
    4.2: The Organiser will not be responsible for any damage to or loss of clothing or other personal items resulting from participation in the Activities.
  1. CANCELLATIONS/ AMENDMENTS
    5.1: The nature of City Ninja, as a temporary or ‘pop up’ event means it is not possible to offer refunds if you are unable to attend a session you have booked.  Within reason we will allow transfers to another session or venue, but this is subject to availability and at our discretion.  To make an amendment to your booking you should contact us via the Eventbrite booking page.
    5.2: Extreme Adventure Ltd shall be entitled to cancel your booking at any time. In the event that we decide to cancel your booking it shall use its reasonable endeavours to notify you as soon as possible. You shall be entitled to a full refund in the event of cancellation under this clause but no other compensation shall be payable.
    5.3: In the event that it proves necessary to close the Activity for reasons beyond the control of Extreme Adventure Ltd., and in circumstances where you/your party has commenced participation in the Activity, you shall not be entitled to any refund (in part or in whole). In such circumstances We may, but shall not be obliged to, offer alternative dates or times at reduced rates.
  2. PRICE AND PAYMENT
    6.1: Subject to any terms agreed in writing between the Organiser and you, our charges shall be calculated at our current rates and payment in full shall be due at the time of booking, and are as quoted on the online event booking form.
    6.2: The price paid does not include any parking charges at the venue.
  3. LIABILITIES
    7.1: Except as otherwise provided in these Terms and Conditions Extreme Adventure Ltd shall not be responsible for the loss, or damage, of or to any property or to any person arising from the booking of or participation in the Activity.
    7.2: Vehicles are left at the venue at the owner’s risk and subject to any conditions and the payment of any fees as may be required by the provider of such facilities at the site location.
    7.3: Except as otherwise provided in these Terms and Conditions any liability of Extreme Adventure Ltd shall be limited to the refund of any charges paid to Extreme Adventure.
    7.4: Nothing contained in these Terms and Conditions is intended to nor shall limit the liability of Total Ninja in respect of death or personal injury caused by the negligence of Total Ninja or of its employees, agents or contractors.
  1. MISCELLANEOUS
    8.1: If any of these terms are determined to be illegal invalid or otherwise unenforceable it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and continue to be binding and enforceable.
    8.2: Nothing above shall confer on any third party any benefit or the right to enforce any of these Terms and Conditions.
  2. EVENTS OUTSIDE OUR CONTROL (FORCE MAJEURE)
    We will not be liable for any failure or delay in performing Our obligations where that failure or delay results from any cause that is beyond Our reasonable control.  Such causes include, but are not limited to: traffic and / or inclement weather, inclement weather rendering the use of Equipment impossible, power failure, internet service provider failure, industrial action, civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism, acts of war, governmental action, epidemic or other natural disaster, or any other event that is beyond Our control. Time shall not be of the essence in this contract.
  3. GOVERNING LAW AND JURISDICTION
    These Booking Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales and you submit to the exclusive jurisdiction of the courts of England and Wales.
